SERVICE AGREEMENT - TERMS AND CONDITIONS

When you place an order and/or become a member of MedicAlert you agree to the following terms and conditions:


1) Orders

  • MedicAlert manufactures and supplies personalised medical identification jewellery and provides an annual membership service
  • MedicAlert accept orders via post, telephone or through its website www.medicalert.org.uk
  • Please read and carefully check your order before placing it including jewellery size, medical information and personal details
  • MedicAlert reserves the right to cancel an order or refuse a membership renewal at its discretion

2) Delivery

  • MedicAlert aim to deliver your order to you within 10 working days of it being placed
  • MedicAlert do not accept liability for loss or damage to orders once they have been delivered

3) Cancellation 

  • All of the jewellery manufactured and supplied by MedicAlert is personalised therefore the cancellation rights contained in the Consumer Rights Act 2015 do not apply
  • MedicAlert does not accept returns or offer refunds for cancelled orders

4) Returns 

  • If for any reason upon delivery your order is faulty MedicAlert will offer to repair or replace the jewellery or refund the full price of the jewellery within 30 days of receiving your order
  • MedicAlert will only offer refunds for items which are faulty
  • If you require any alterations to your jewellery you agree that you are responsible for any additional payments for the alteration including postal charges

5) Warranty

  • MedicAlert guarantee all jewellery shall be free from any faults for a period of 12 months from the date of order
  • If within the warranty period the jewellery becomes faulty MedicAlert will repair, replace or refund the full price of the jewellery
  • The warranty does not include general wear and tear such as tarnishing to the jewellery or damage to the enamel
  • If you require a repair to your jewellery outside the warranty period please contact MedicAlert for details of the repair cost and postal charges

6) MedicAlert membership

  • By becoming a member of MedicAlert you agree that MedicAlert will hold a confidential record containing your medical information and personal details which is reviewed by a nurse. MedicAlert will only disclose the information held on your record to medical or emergency professionals who are assisting you
  • The membership subscription fee is an annual payment and includes MedicAlert keeping a confidential electronic record with your personal and medical information and providing details from this record if required in an emergency 24 hours a day, 7 days a week.
  • The membership subscription is for 12 months from the date payment is received and payment for annual membership is non-refundable
  • In order to renew your membership subscription with MedicAlert you must make payment before your existing membership subscription is due to end
  • If you fail to renew your membership your record will be cancelled and your details will no longer be available to the MedicAlert emergency team
  • If an existing MedicAlert member wishes to continue their membership after they attain the age of 18 years, MedicAlert ask that renewing the membership and updating medical information and personal details becomes that member’s sole responsibility except if a member is considered vulnerable and unable to do so for whatever reason

7) Personal Information

  • MedicAlert will not disclose your medical information or personal details to any unrelated third party other than in an emergency situation
  • You agree to contact MedicAlert once a year to confirm that the information MedicAlert hold on your record is correct
  • You are responsible for updating MedicAlert of any changes to your medical information or personal details if necessary. However, you reserve the right to consent to another person(s) updating your record on your behalf
  • If MedicAlert need to verify any information that you have provided you must respond to any requests for verification made by MedicAlert or your details will not be updated

8) Cancelling your membership

  • If you decide to cancel your membership you are able to do this at any time by contacting MedicAlert
  • MedicAlert will not refund the membership subscription payment if you decide to cancel your membership before it is due to end
  • If you choose to cancel your membership and continue to wear your medical ID jewellery without a valid membership you agree that the MedicAlert emergency team will not be able to access your record or provide your details to medical or emergency professionals
  • When you cancel your membership MedicAlert will retain your name and address for marketing purposes. If you do not wish MedicAlert to hold these details you can contact MedicAlert to remove them

10) Applicable law 

  • Any dispute or claim arising from these terms and conditions will be determined by the laws of England and Wales, and considered exclusively by the English Courts
