2. Compliance with Terms of Use

By accessing and using the Platform, you warrant and represent to MedicAlert that you have read, understood, and agree to be bound by these Terms of Use.

3. Access to Platform

In order to be entitled to access the Platform to view a member's health records, you must be a registered medical professional, paramedic, authorised first responder, or a verified carer/guardian of the member acting in an official capacity or under urgent care requirements.

4. Lawful Basis & Legitimate Purposes (UK GDPR Compliance)

The Platform must be used for legitimate emergency medical and healthcare purposes only. By accessing a member’s health records, you confirm and warrant that you are doing so in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 under one or more of the following lawful conditions:

  • Article 6(1)(d) & Article 9(2)(c) (Vital Interests): Processing is necessary to protect the vital interests of the member or another natural person where the member is physically or legally incapable of giving consent (e.g. preventing or lessening a serious threat to life, health, or safety in an emergency).
  • Article 6(1)(e) & Article 9(2)(h) (Healthcare & Public Task): Processing is necessary for the performance of a task carried out in the public interest, or for medical diagnosis, the provision of health or social care, or treatment pursuant to professional secrecy requirements.

You agree to use the Platform in a manner that does not abuse its functionality, or otherwise restrict or affect the ability of others to access and use the Platform.

5. Confidentiality, Data Protection & Caldicott Principles

  1. Permitted Use: By accessing the Platform and viewing member health records, you acknowledge and agree that you will not disclose or use any information contained therein for any purpose other than the legitimate medical and care purposes stated in Clause 4.
  2. Confidentiality: You agree to keep strictly confidential, and will not directly or indirectly disclose (or allow to be disclosed) to any unauthorised third party, any aspect of the member's personal data or special category health data.
  3. Breach Notification: You must inform MedicAlert immediately upon becoming aware of, or suspecting, any unauthorised access to, compromise of, or improper disclosure of a member's personal or health information.
  4. Lawful Disclosure: You are permitted to disclose the member's personal or health information to relevant healthcare providers or third parties only where required or explicitly permitted by law (e.g. under UK GDPR, Data Protection Act 2018, or a court order).
  5. Data Storage & Downloads: You must not attempt to download, scan, copy, print, screenshot, or otherwise capture information contained on the Platform, except where strictly necessary for immediate patient treatment (e.g. attaching to an ambulance run sheet or hospital clinical management system). You must safely destroy or delete temporary local copies once the immediate treatment purpose has concluded, unless retention is mandated by clinical governance or legal obligations.
  6. Session Security: You must ensure that you close your web browser session immediately after accessing the record. You acknowledge that failure to do so may result in an unauthorised disclosure of personal data, in breach of UK data protection laws.
  7. Caldicott Compliance & Minimal Data Principle: In accordance with UK Health and Social Care Information Governance (the Caldicott Principles), you agree to justify the purpose of access and use only the minimum patient-identifiable information necessary for immediate clinical or emergency decision-making. Accessing data beyond what is strictly necessary for patient care is a material breach of these Terms and may be reportable to your professional regulator (e.g. GMC, HCPC, NMC) and the Information Commissioner's Office (ICO).
  8. Survival: The obligations of confidence under these Terms of Use continue in full force indefinitely following your use of the Platform.

6. Use of Platform & Intellectual Property Rights

  1. Restrictions: You must not copy, reproduce, modify, alter, adapt, or merge any part of the Software or Platform without MedicAlert's prior written consent. You must not reverse engineer, decompile, or disassemble the Software.
  2. IP Ownership: Accessing the Platform grants you a limited, non-exclusive, non-transferable licence to view records as authorised. No title, ownership, or intellectual property rights in the Software or Platform are transferred to you.
  3. Equitable Relief: Unauthorised use, reproduction, or transfer of the Software or Platform will entitle MedicAlert to seek equitable remedies (including injunctive relief) in addition to any monetary damages.

7. User Responsibilities & Warranties

  1. Accountability: You are solely responsible for your use of the Platform and any device used to access it. MedicAlert has no obligation to monitor your individual usage, though it reserves the right to audit access logs for compliance, security, and information governance verification.
  2. Authority Warranty: You warrant that you possess the necessary professional credentials, authority, and capacity to enter into and perform your obligations under these Terms of Use in compliance with applicable UK laws and clinical guidelines.

8. Disclaimers

  1. "As-Is" Service: To the fullest extent permitted by law, the Platform and Software are provided on an "as is" and "as available" basis without warranties or guarantees of any kind, whether express, implied, or statutory (including fitness for a particular purpose or error-free operation).
  2. Data Accuracy: Information available on the Platform is supplied directly by the member (or their authorised representative). While MedicAlert takes reasonable measures to enable members to keep records accurate and up to date, MedicAlert cannot guarantee the absolute accuracy or completeness of member-provided data. Where available, the Platform will indicate when the record was last updated. Professional clinical judgement should always be exercised.
  3. Technical Malfunctions: MedicAlert is not responsible for platform downtime, network failures, telecommunications outages, or hardware errors that prevent access to records during an emergency.

9. Limitation of Liability

  1. Exclusions: Subject to Clause 9.2, MedicAlert will not be liable for any direct, indirect, special, or consequential loss, or for loss of data, arising out of or in connection with your use of (or inability to use) the Platform, or reliance on information accessed through it.
  2. Statutory Exceptions: Nothing in these Terms of Use excludes or limits MedicAlert's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
  3. Cap on Liability: Subject to Clause 9.2, MedicAlert’s total aggregate liability to you arising under or in connection with these Terms of Use shall not exceed £100.

10. Indemnity

You agree to indemnify and hold harmless MedicAlert, its trustees, officers, employees, and agents from and against any claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms of Use, unlawful use of the Platform, or unauthorised disclosure of member personal data.

11. Governing Law & Jurisdiction

These Terms of Use, their subject matter, and their formation are governed by the laws of England and Wales. You and MedicAlert both agree that the courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms of Use.

12. General Provisions

  • Entire Agreement: These Terms of Use constitute the entire agreement between you and MedicAlert regarding access to and use of the Software and the Platform.
  • Waiver: Failure by MedicAlert to enforce any provision does not constitute a waiver of its right to enforce that or any other provision in the future.
  • Severability: If any provision of these terms is held invalid or unenforceable by a court, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
